This site gives general information and FREE tools, not professional advice. We never guarantee rankings, leads or sales, and our paid services are covered by a separate written agreement.
Acceptance of these terms
These Terms of Use (the “Terms”) govern your use of one80consultation.com, our FREE tools, the site assistant and any other online content from One80 Consultation LLC (“One80,” “we” or “us”), together the “Site.” By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. If you are using the Site for a business, you confirm you have authority to bind that business.
Information only, not professional advice
The Site provides general information about marketing, search engine optimization, websites, and business growth. It is not legal, tax, accounting, financial or other professional advice, and using the Site does not create a consultant-client relationship. Our services are provided under a separate written agreement. If this Site and a signed agreement conflict, the signed agreement controls for those services.
No guarantee of results
Search engine rankings, AI search recommendations, website traffic, leads, calls and sales depend on many factors outside our control, including competitors, search engine and AI platform changes, and your own business. We do not guarantee any ranking, placement, traffic, lead volume, revenue or timeline. Examples, estimates and averages on the Site are illustrative only and are not promises of what you will achieve.
FREE tools and the site assistant
Our calculators, quizzes, tests, generators and the site assistant are provided “as is” for general guidance. Results are estimates based on the information you enter and on assumptions that may not fit your business. Assistant answers and generated text can be incomplete or wrong, so check anything important before relying on it. Data you enter into the tools is stored in your own browser unless you submit it to us. Assistant chats may be saved so our team can follow up, as described in the Privacy Policy, so please do not share sensitive information in them.
Offers and promo codes
Promo codes and special offers are for new clients only, one code per business, and cannot be combined with other offers unless we say so in writing. We may ask you to confirm eligibility, such as business ownership, business start date or proof of service for veterans. Offers apply to the services and billing terms stated with the offer, may change or end at any time, have no cash value, and are subject to a signed agreement or completed checkout.
Purchases
When our shop is open, prices, what is included and any refund terms are shown at checkout, and payments are processed by a third-party payment provider whose terms also apply. Digital products are delivered by a secure download link or access email. Fixed-price website packages begin after payment and receipt of the information we need from you.
Intellectual property
The Site, including its text, design, code, graphics, logo, tools and the One80 name, is owned by One80 or its licensors and is protected by copyright, trademark and other laws. We grant you a limited, revocable, non-transferable license to view the Site and to use the FREE tools for your own business purposes. You may not copy, scrape, resell, reverse engineer or build a competing product from the Site, or use our name or logo without written permission. What we deliver to a client is owned or licensed as stated in that client’s agreement.
What you send us
You are responsible for the accuracy of what you submit and must have the right to share it. By submitting information, you allow us to use it to respond to you and provide our services, as described in the Privacy Policy. We do not publish your name or a testimonial from you without your permission.
Acceptable use
You agree not to misuse the Site. In particular, you will not: break the law; attempt to gain unauthorized access to the Site or its systems; interfere with its operation; introduce malware; use bots or scrapers to collect content or data; send spam or false information through our forms; or harass anyone.
Partners and third-party sites
We link to and recommend partners, such as Mission Sierra Media and Chronoloq, and to other third-party sites. They are independent businesses. We recommend them based on our own experience, but we do not control their services or content, and any agreement you make with them is directly with them. We are not responsible for their products, services, pricing or privacy practices.
Disclaimer of warranties
To the fullest extent permitted by law, the Site is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or secure.
Limitation of liability
To the fullest extent permitted by law, One80 and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Site. Our total liability for any claim relating to the Site is limited to $100. Liability for paid services is governed by the written agreement for those services. Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnification
You agree to defend and indemnify One80 against claims, losses and reasonable expenses arising from your misuse of the Site or your violation of these Terms or applicable law, to the extent permitted by law.
Governing law and disputes
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and try to resolve the issue informally for at least 30 days. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Mahoning County, Ohio, and you consent to their jurisdiction.
Accessibility
We work to make the Site usable by everyone, including people who use assistive technology, and we aim for the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. Changes to these terms
We may update these Terms from time to time. The updated version will be posted here with a new “Last updated” date, and your continued use of the Site means you accept the changes.
General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and us about your use of the Site.
